Human Rights in Southeast Asia in Times of Pandemic

In the ASEAN region as elsewhere in the world, the COVID-19 pandemic has created a genuine health emergency, prompting governments to take extraordinary, unprecedented measures in an effort to curb its lethal impact. While measures were taken by ASEAN Member States to genuinely combat the proliferation of the virus, others used it, sometimes concurrently, as a pretext for increasing oppression and violating human rights. Some measures have proven to be detrimental particularly to groups that are routinely subject to abuse.
Between March and May 2020, FORUM-ASIA together with the network of Solidarity for ASEAN Peoples Advocacy (SAPA) and SHAPE-SEA, conducted a series of webinars to discuss the measures taken by ASEAN and its Member States in the context of the COVID-19 pandemic and their impact on the human rights situation on the ground.
The report “Human Rights in Southeast Asia in Times of Pandemic” summarised the proceedings of the webinar series, while FORUM-ASIA’s poster series gathered all the key information and learnings of the report, with the aim of promoting them to the wider public.

ASEAN Member States have attempted to prevent the COVID-19 from spreading by implementing a wide array of measures. FORUM-ASIA has documented at least four trends related to measures implemented by ASEAN Member States to curb the pandemic:
๐Lack of transparency and placing restrictions on COVID-19-related information;
๐Oppressive law enforcement by the military and the police;
๐Arbitrary restrictions on the rights to freedom of expression, peaceful assembly and the right to privacy under the pretext of safeguarding national security and preventing riots;
๐More pernicious injustice and increased vulnerability of marginalised groups.
However, these efforts often fail to address public health and human rights perspectives by emphasising a militaristic approach. It only further increases the already high mortality and morbidity rates, and exacerbates the vulnerabilities and risks faced by marginalised communities, including the homeless and LGBTIQ groups

A number of ASEAN Member States have deployed not only the police but also the military to enforce regulations to prevent the spread of COVID-19. The situation created a climate that favours securitisation and risks violence in law enforcement.
The pandemic has also led to a rise in racism and xenophobia, especially against races and ethnicities considered unjustifiably to be responsible for causing and spreading the disease.
Civil society, academia, and related stakeholders have responded to these worrying developments, and some have criticised various institutions in ASEAN for failing to monitor human rights violations in the region during the pandemic.
Despite the existence of the ASEAN Post-2015 Health Development Agenda ๐ฉโโ๏ธ as a strong base for promoting a resilient and transparent health system that guarantees full enjoyment of all to tackle the pandemic, ASEAN governments seem to ignore the commitment to uphold these principles due to a lack of political will.

Efforts by governments of ASEAN Member States to manage the COVID-19 pandemic has had wide-ranging impacts beyond the health-related issues, including economic and social ones.
The hardest downstream blow has certainly been to the #economy. And among the groups most affected by government policies to curb COVID-19 are people living in poverty, women and girls, and LGBTIQ communities.
The pandemic has brought disproportionate impact to the LGBTIQ community, whose needs for equal treatment and opportunities in all sectors have been denied by the Member States on daily basis due to the pre-existing conservative patriarchal, religious, as well as hetero- and cis-normative values imposed by society in the region.
Among other things, the pandemic has brought limitation to access for basic needs and decent work, disruption on the existing health and psychosocial services, and escalation of further stigma and discrimination for the community

The COVID-19 outbreak has not only hindered or even paralysed many economies, it has also significantly hampered human mobility. It has primarily affected vulnerable groups such as refugees fleeing conflict or war, stateless people, asylum seekers, internally displaced persons (IDPs), and undocumented migrants - groups who, even during โnormalโ times, already face #discrimination and abuse.

The current global health crisis caused by the COVID-19 pandemic has increasingly magnified the challenges the region faces in promoting and protecting the rights of every person with disabilities in ASEAN.
In less than six months, more than 90 million people with disabilities have lost access to routine health care, medical and non-medical countermeasures, and treatments. It is because of poorly designed containment measures that are often not consulted, coordinated or communicated with people with disabilities and their organisations.

More than four months after the first ASEAN Member States went into #lockdown, governments in the region are starting to combine emergency response measures with more long-term recovery plans.
However, opportunistic governments in Asia are expanding their power under the guise of COVID-19 to protect businesses whose activities have led to environmental, human rights abuses and attacks on activists.
These measures disproportionately target community-based human rights defenders, among others are the land and environmental human rights defenders as well as indigenous peoplesโ rights defenders.
Now more than ever, social dialogue matters and it is incumbent on all stakeholders โ be it business, government or civil society โ to seek out opportunities for deeper engagement, to consider and weigh all views and perspectives, and through these processes help shape our shared future.

Warfare-like or militaristic approaches, including the emergency laws and measures by some countries in managing the COVID-19 outbreaks, have shown to be misused to impede the legitimate work of human rights defenders and further endanger their safety.
Such approaches have involved arrests of people who violate curfews or defy lockdown orders and people speaking up or commenting on the governmentโs actions in dealing with the pandemic, or just criticising governments in other contexts.
The governmentโs move to use technology-based surveillance to monitor outbreaks may help contain the epidemic, but it can also be abused and threaten human rights defenders. The right to privacy could be endangered in the long term without a comprehensive assessment and data protection mechanism in the region.
